Abrogation of Article 370 on August 5th, that granted special status to J&K by the central government vide presidential order is a bold & pertinent step towards national interests while encompassing precise interests of Kashmiris. The move is constitutional due to the temporary provision of Article 370, albeit suspending the internet services and restricted movements, initially in an altruistic sense incorrectly appears as if disturbing the spirit of basic human rights guaranteed by constitution of India & International laws under safeguard of UN. However, this isn’t the first time the valley has seen unrest; the frantic developments in recent years have seen several occasions of internet shut downs owing to the political & terrorism related developments in the valley. They have been documented, to be misused by Pakistan to foster fake news and propaganda based unrest and hold the innocent Kashmiri & whole nation to ransom. Such measures are incorporated temporarily by governments all across the world, in national interests, to maintain law and order and prevent loss of life.
Pakistan’s Hilarious take on Internet Restrictions
“The access to the internet is the basic right to information, and this type of shut down can never be justified as legal under the human rights law, even during the times of unrest” is the fallible argument rendered by Pakistan & its propelled propaganda apparatus. Actions of the central government can not only be constituted as constitutionally violation of Article 19 (1) (a) of the constitution, but also demeans the democratic freedom of the citizens is the preposterous and false presentation of facts. While central government declared the move as a precaution to security concerns of the Valley, how this temporary abeyance of the internet raises any serious concerns of so called “grave violation of basic human rights” is not palatable to Indians as well as international community. There is a logical reason for the same, stated in Indian constitution and which as well takes its roots in the United Nations Human Rights Council passed resolution vide A/HRC/32/L.20 based on the International Covenant on Civil and Political Rights(ICCPR). Article 19/1 of ICCPR says “Everyone shall have the right to hold opinions without interference” and Article 19/2 says “Everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice”, is frequently quoted, without bringing out the overriding provisions given by Article 4 of the same. As more importantly, the same Article 19/ 3 says “the exercise of the rights provided for in paragraph 2 of this article carries with it special duties and responsibilities. It may therefore be subject to certain restrictions, but these shall only be such as are provided by law and are necessary: (a) For respect of the rights or reputations of others; (b) For the protection of national security or of public order (order public), or of public health or morals”. This in conjunction with Section 144 of the Code of Criminal Procedure (CrPC) of India, has been found to be absolutely legal, in our national interests (similar provisions exist in other nations, who use them as judiciously to maintain their sovereignty) duly acknowledged by UN as well as Indian top courts.
Above facts are conveniently kept from their own public by Pakistan as well as gullible trusting users on internet platform, while UN as well as international media routinely reprimand Pakistan for the misleading rancor . International community refuse to entertain above non-facts.
Genocide Bogey by a Delusional Pakistan
While above falls flat on its face, giving it international snub, Pakistan comes up with a fantasized theme of “Genocide”. Albeit laughable it also incurred reprimand from all over the world including neutral Press. DW News anchor, to none other than Pakistani Ambassador to Germany, was very explicit in pointing out this incorrect and misleading line taken by Pakistan rather in an admonishing and exasperating tone. Repeatedly queried on giving out one single fact indicating Genocide, the Pakistani Ambassador drew a blank every time and could only blabber about on “Internet Restrictions”. While Pakistani Minister for Foreign Affairs used the Genocide bogey during UN General Debate, 73rd Session few months back and was forgiven, given the sanctity of the forum, all countries including the Arab Block, International media, and journalists from all paces minced no words towards ridiculing this asininely illogical rhetoric, everywhere else.
Since abrogation of Article 370, Pakistan’s high-pitched campaign over the past one week has left the country more isolated than ever on Kashmir. Kashmiris, sensing they in a first, have their right to be a comprehensive part of the festive sprirt Indian democracy and unique opportunity to be free of being held at Gunpoint by Pakistan based terrorism narrative, have welcomed the step. Pakistan caught off balanced and not being able to digest the fact that Kashmir now moves further away from its evil designs and reach, went from lukewarm narrative of “Temporary Internet restrictions as human rights violations” to a flustered response of “Genocide”. It has been given befitting reply by UN, India, international community as well as people from Pakistan Occupied Kashmir (POK). Its outcome can further dilute credibility of Pakistan, if not reaffirming it being a non-serious barmy state. While its immediate audience is the gullible common man in Pakistan, it also designs to use this narrative to incite protests in Kashmir. This is aptly seen through by Kashmiris including our brethern from POK. Baffled and unimaginative minds of Pakistan Army have no other space to turn to, given realities on ground, and shall keep up with that rhetoric along with intent to foment more trouble, like the sabotaging of business interests and disrupting path to normalcy of innocent Kashmiris using Pakistan controlled terrorists from across.
